We respect and are committed to protecting your privacy, and we support a general policy of openness about how we collect, use and disclose your personal information.

This Privacy & Security Policy (the “Policy”) informs you how SwitchRX collects, uses and discloses the personal information that you provide to us through use of our Website and creating an account to use our services. By visiting the Website, creating an account to use our services or otherwise using any SwitchRX online service, you consent to the collection, use and disclosure of your personal information in accordance with this Policy.

Account Creation and Service Delivery

When you sign up for an account with SwitchRX, we ask for your full name, email address, address, fax number and a password. We use this information to process and maintain your account request or facilitate the provision of other services you request from us.

For example, we use your email address to answer inquiries that you send to us, and to communicate with you when necessary concerning the administration of your account and any feedback you may provide. As these functions are necessary to the proper administration of your account and our related services, we do not offer an opt-out from providing your email address for such communications.

We use your address and contact information in order to ascertain your location and time zone, which allows us to learn about who is using our site. This will allow us, in future, to provide information localized for your needs and interests.

Except as may be required by law or provided herein, we will not use this information for third party marketing or any other purpose.

Use of Personal Information

SwitchRX will not sell, license, trade or rent your personal information. SwitchRX will not otherwise disclose your personal information except as described below.

SwitchRX may also disclose personal information about its members to a third party if (a) a law, regulation, search warrant, subpoena or court order legally requires or authorizes us to do so; or (b) necessary to enforce and protect the terms and conditions of our agreement(s) with you or the Terms of Use applicable to your use of the Website.

SwitchRX also reserves the right to disclose and/or transfer personal information to a third party in the event of a proposed or actual purchase, sale, lease, merger, amalgamation or any other type of acquisition, disposal or financing of all or any portion of SwitchRX or of any of the business or assets or shares of SwitchRX, provided that the third party represents that it will continue to use the information for the purposes set out in this Policy and in accordance with applicable privacy protection laws.

  1. Retention of Your Personal Information

We retain your personal information for the period that you remain a user for the purposes described above, and following the termination or suspension of your account for such further periods as required by applicable laws or limitation periods and as necessary to allow us to guard against fraud. In the event you decide to suspend and then reactivate your subscription with SwitchRX, you may be prompted to confirm your personal information at that time if your personal information continues to be retained by SwitchRX for the purposes described above.

To submit a question to us about the collection or use of your personal information, please email us at info@switchrx.ca and insert “Privacy Information Question” in the subject header. If requested, SwitchRX will provide you with a copy of your personal information in electronic form, which may include:

  • what personal information SwitchRX is storing;
  • where it is being stored; and
  • for what purpose we are storing it.

At any time, you may request that we remove your personal information from our records and we will delete your personal information within seven (7) days of such request.

  1. How We Protect Your Personal Information

SwitchRX uses commercially reasonable efforts to protect your personal information from loss, unauthorized access, misuse or theft. Only SwitchRX staff who have a legitimate business purpose for accessing the personal information collected by SwitchRX are authorized to do so. Unauthorized access to or use of personal information by anyone affiliated with SwitchRX is prohibited and constitutes grounds for disciplinary action.

In the unlikely event that our system is breached, and your personal information has been compromised, we will notify such local authorities as may be required within seventy-two (72) hours of the breach, and will also use our best efforts to notify you, using the most current contact information that we have on file. We are not responsible for any failure to notify you based on incorrect or outdated contact information.

  1. Medication Information

Notwithstanding anything else in this Privacy Policy, SwitchRX may collect, store, or share information you provide to SwitchRX regarding the change of medications and such information may include, but shall not be limited to, the reasons for the change, the medications changed from and to, the previous and current dosage, the treatment duration, and any other data reasonably related to the transition to a new medication or combining medications including, not limited to, the geographical location of the patient, your medical accreditation, as well as the medical accreditation of any other medical professionals overseeing the change or combination (the “Medication Information”).

You hereby agree that SwitchRx may make use of the Medication Information and include such information in data, reports, or other documents prepared by SwitchRX for its own use or for submission to third-parties.

SwitchRx represents and warrants that, where SwitchRx makes use of the Medication Information in a report or other document, SwitchRX will remove from the Medication Information any information which is reasonably likely to lead to the identification of an individual.

Where your use of SwitchRX’s website or services predates this policy regarding Medication Information, your continued use of the services or website shall constitute your acceptance of such policy and your consent to SwitchRx’s use of any Medication Information previously submitted by you to SwitchRX.

  1. Links to Third Party Sites

The Website contains links to other third party websites. You should be aware that operators of linked websites may also collect your personal information (including information generated through the use of cookies) when you link to their websites. SwitchRX is not responsible for how such third parties collect, use or disclose your personal information, so it is important to familiarize yourself with the privacy policies of these websites before providing your personal information on those sites.
